N.D. Cent. Code § 32-10.1-02
in effect32-10.1-02. Notice and opportunity for hearing
1. Except as provided under subsection 2, the court may issue an order under this
chapter only after notice and opportunity for a hearing appropriate in the
circumstances.
2. The court may issue an order under this chapter:
a. Without prior notice if the circumstances require issuance of an order before
notice is given;
b. After notice and without a prior hearing if the circumstances require issuance of
an order before a hearing is held; or
c. After notice and without a hearing if no interested party timely requests a hearing.
